1. The Free Offer
In listing a Free Offer (The Offer) The Advertiser agrees
that such offer complies with the ‘truth in advertising’
conditions of the Trade Practices Act and that The Advertiser
shall fulfil the entire conditions of The Offer including redemption
of The Offer and delivery within the time specified.
2. Approval Of Offer
All listings shall be subject to the joint prior approval
of Free Supermarket and The Advertiser before ‘going live’.
3. Variations To The Offer
Should any variation occur in the ability of The Advertiser
to fulfil the exact conditions of The Offer, such variation shall
be immediately communicated to Free Supermarket. This shall include
stock-outs, delivery delays or any change in specification of
The Offer whether goods or services.
4. Responsibility For The Offer
The Advertiser shall assume full responsibility for all
aspects (legal and otherwise) of The Offer. Specifically, Free
Supermarket is providing a national Australian website for the
advertising of Free Offers in the role of a media provider only.
5. Responsibility of Free Supermarket
Free Supermarket shall be specifically responsible for
the operation of its internal systems to deliver all operating
aspects of The Offer as accepted for listing, but not for any
deficiencies emanating or caused by any third party supplier to
Free Supermarket (such as an ISP or telecommunications supplier).
Specifically, Free Supermarket shall not be responsible for any
technical malfunction of any computer online system, server or
provider, computer equipment, software, technical problems or
traffic congestion on the internet or any website or any combination
thereof, or any other technical failures, including any injury
or damage to The Advertiser’s, participant’s or any
other person’s computer related to or resulting from participation
in or downloading of any materials and it shall be the responsibility
of the advertiser to inform participants in its promotion of this
warranty if it sees fit.
6. Trading Terms & Payment
Free Supermarket shall invoice The Advertiser monthly.
This invoice shall be due and payable within 30 days from invoice
date. In the event of trading terms not being met by the advertiser,
Free Supermarket reserves the right to remove any promotion from
the Free Supermarket site (freesupermarket.com.au).
7. Refusal Of Listing & Delisting
Free Supermarket reserves the right to refuse any listing
or delete any listing at any time without notice.
